Child custody matters in Pakistan are governed by the Guardians and Wards Act 1890 and the Muslim Family Laws Ordinance 1961, handled by Family Courts.
Hizanat (Physical Custody)
Day-to-day care of the child — typically awarded to the mother until a son turns 7 or a daughter reaches puberty.
Wilayat (Legal Guardianship)
Authority over the child's property and major decisions — typically remains with the father.
These are general rules — the court always prioritizes the child's welfare above all and may deviate from them.
